This agreement (the “Agreement”), made this ____________________, ____, is between ___________ (“Seller”) and ________________________________ (“Buyer”).

DESCRIPTION OF DOG BEING SOLD

Buyer agrees to purchase from Seller a purebred Akita (herein referred to as the “Akita”) of the following description:

  1. PURCHASE PRICE

Buyer agrees to pay Seller a purchase price of $__________ for the Akita, less Buyer’s deposit of $__________.  The balance is due from the Buyer on or before receipt of the Akita.

  1. GENERAL TERMS
  2. Seller certifies that the Akita is in good health, is appropriately vaccinated and is free of internal parasites.  Buyer may return the Akita for a full refund of the purchase price within 72 hours of delivery of the Akita.  Within this time period, at the Buyer’s expense, Buyer should have the Akita examined by a veterinarian.
  3. American Kennel Club (“AKC”) registration papers shall be transferred to Buyer within 30 days of delivery of the Akita.  The Akita shall have Limited Registration.
  4. Buyer agrees as follows:
    1. Buyer shall provide complete veterinary care for the Akita, including regular immunizations and health checkups by a licensed veterinarian and monthly or daily heartworm preventative, at Buyer’s sole expense.
    2. Buyer shall ensure that the Akita is fed premium quality dog food.  Akita is currently being fed ___________________.
    3. Buyer shall keep the Akita as a house dog with a properly fenced yard (minimum fence height of (5) five feet) or in a kennel run with proper housing.  Buyer agrees that at no time will the Akita be chained or allowed to run free outside a confined area. 
    4. Buyer agrees at all times to maintain and care for the Akita in a reasonable and humane manner, with due regard for the health and well-being of the Akita.  Buyer shall not abuse or neglect the Akita or allow others to abuse or neglect the Akita.
    5. Buyer agrees to keep the Akita at a healthy weight and Buyer understands that an improper weight, particularly overweight, can cause the Akita significant health problems.
    6. Buyer agrees that the Akita shall have the name “_____Blue Moon___” starting at the beginning of the Akita’s AKC registered name before submitting the registration papers to the AKC.

 

  1. Buyer agrees to limit the Akita from climbing stairs and strenuous exercise for the first 24 months.

  3. Seller agrees as follows:
    1. Seller shall provide Buyer with any advice or assistance pertinent to care, feeding, grooming, training, etc… of the Akita upon request from the Buyer.
    2. Seller will offer at no charge a four week introductory obedience class for the Akita.   The obedience class will take place at Seller’s kennel facilities, at a mutually agreed-upon date.  The Buyer, at Buyer’s sole expense, will provide transportation of the Akita to and from the Seller’s kennel facilities.  The Buyer will also provide any necessary food for the Akita.  The Seller will provide any necessary training tools used during training.  The Buyer has the option to request purchase of training tools. 
    3. Seller agrees to take the Akita back at any time in the life of the Akita, if Buyer can no longer keep the Akita.  If Buyer returns the Akita, Buyer agrees to sign the AKC registration papers back to the Seller.  Buyer will not be entitled to any compensation for the return of the Akita and ultimate disposition of the Akita will be entirely up to the Seller.

  4. GUARANTEES
  5. Seller guarantees the following:
    1. At two years of age, the Akita will be certified free of hip dysplasia by the OFA and free of eye disease by a veterinary ophthalmologist and so registered by CERF.
    2. The Akita will be free of genetic disease which would preclude its living an otherwise normal and healthy life until the age of three years.
  6. Should action become necessary on the part of the Seller under the guarantee (III.A.1-2), Buyer shall have the following options:
    1. Return Akita/replacement puppy.  Buyer may return the Akita to Seller and transfer the registration to Seller.  Disposition of the Akita is entirely up to the Seller.  Seller will replace the Akita with a replacement puppy selected by Seller from Seller’s next available litter.
    2. Sterilize Akita/replacement puppy.  Buyer may keep the original Akita or place it in a mutually agreed-upon suitable home.  Upon proof of sterilization and/or placement, Seller will replace original Akita with a replacement puppy selected by Seller from Seller’s next available litter.

Seller reserves the right to have a second veterinarian of Seller’s choice evaluate the Akita’s condition before honoring guarantee.  Buyer reserves the right to choose which option they prefer (B.1-2).

  1. REMEDIES
  2. Buyer’s failure to comply with Section II.C.1-8 hereof will void the Seller’s guarantees set forth in Section III of this Agreement.
